Billing and Payments

Failure to pay may result in suspension or termination of access.

Subscription Renewals

Unless cancelled, subscriptions automatically renew at the end of each billing period. You may cancel your subscription at any time through your account settings or by contacting support.

Refund Policy

Except where required by Australian Consumer Law:

• Subscription payments are non-refundable.
• Partial billing periods are not refunded.
• Unused portions of subscriptions are not refunded.

Refund requests may be considered at our sole discretion. Nothing in these Terms excludes rights available under Australian Consumer Law.

User Content

Users may upload assessment materials, rubrics, marking guides, feedback comments, and educational resources. You retain ownership of your content.

By uploading content, you grant Marking Assistant Application a limited licence to store, process, and display the content solely for providing the Service.

Acceptable Use

You agree not to:

• Use the Service for unlawful purposes.
• Upload malicious software or harmful code.
• Attempt unauthorised access to systems.
• Interfere with service operations.
• Reverse engineer the platform.
• Share accounts with unauthorised users.
• Upload content that infringes intellectual property rights.

Violations may result in immediate suspension or termination.

Intellectual Property

All rights, title, and interest in the Marking Assistant Application software, website content, branding, logos, and documentation remain the exclusive property of Marking Assistant Application and its licensors. No ownership rights are transferred to users.

Availability of Service

We aim to provide reliable service but do not guarantee continuous availability, error-free operation, or uninterrupted access. Maintenance, upgrades, outages, or circumstances beyond our control may affect availability.

Data Backup

While we implement reasonable backup procedures, users remain responsible for maintaining copies of important information and records. Marking Assistant Application is not responsible for loss of user data resulting from circumstances beyond our reasonable control.

Limitation of Liability

To the maximum extent permitted by law, Marking Assistant Application will not be liable for indirect damages, consequential damages, loss of profits, loss of business opportunities, or loss of data arising from the use of, or inability to use, the Service.

Our total liability for any claim shall not exceed the amount paid by the user during the previous twelve months.

Indemnification

You agree to indemnify and hold harmless Marking Assistant Application, its officers, employees, contractors, and affiliates from claims arising from:

• Your uploaded content.
• Your violation of these Terms.
• Your infringement of third-party rights.

Termination

We may suspend or terminate access immediately if:

Upon termination, access to the Service may cease immediately. Subscription fees already paid remain non-refundable unless required by law.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights that cannot legally be excluded under the Australian Consumer Law. Where applicable, statutory guarantees remain in effect.

Changes to Terms

We may update these Terms periodically. Updated Terms will be published on this page with a revised date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Queensland, Australia, and the Commonwealth of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
